Worker misclassification has become a modern HR minefield, leaving employers liable for unpaid wages, taxes, penalties and fines, among other consequences. The legal analysis for determining whether a worker should be classified as an employee or independent contractor can be very confusing, especially when even the IRS and State Governments don't always agree. To avoid worker misclassification and its associated pitfalls, HR managers need to pay careful attention to test factors related to employee classification. The session will outline the best practices of classifying workers to avoid legal pitfalls like:
- The classic "ABC" test factors;
- The IRS's own 20 factors; and
- The "economic realities" test - increasingly applied by State and Federal authorities.

Mr. Singerman's presentation will focus on the fast changing landscape for health plans and the health reform mandates coming on line in 2012 and 2013.
