Who Polices the Trade Remedies Bar’s Ethics, and How?

A distinguished panel will address how the District of Columbia Bar, the International Trade Administration of the U.S. Department of Commerce, and the U.S. International Trade Commission respond to potential ethical violations by attorneys in the trade remedies practice.  Ethical lines and what has it meant when they are crossed will be discussed.  This timely topic arises against the backdrop of recent Commerce verifications and other trade proceedings where fraud has been reported.  It raises issues concerning the possible vs. the actual consequences for ethical violations by members of the DC Bar under both “knew” and “should have known” standards.  The broader issues of perceived bias and the differing verification approaches of the two agencies also come into play.  So, too, do questions concerning what ethical sanctions apply to non-lawyers practicing before these agencies, as well as the role of low-bids and outsourcing of legal representation.
