I strongly agree with Lisa’s comments in her e-mail and also in the edits to the document.

 

In the great State of Texas, if you bring such a lawsuit to court and lose, you pay your fees and the fees of the party you brought the suit against.

I think that is a great idea!  Anyway that Ms. Johnson can be punished would be great.  She should experience consequences for bad behaviors.

Very well written brief.  I also read Lisa’ comment and have nothing of substance to add.  Do you know, without researching it what Illinois law states with respect to sanctioning attorneys who deliberately misrepresent or omit contrary authority?  Is that something that we should raise in light of hear intentional omissions and misstatements of the law?
