Discovery
Mr. Sturdy,
As discussed over the telephone, we made a request for the in-car audio/video recordings from the police officer and/or police cruiser recording equipment in the first action (Case No. 10-12635). We were never provided with these. We made an identical request in this action (Case No. 11-10103) and were provided with the in-car audio/video recordings from the police officer and/or police cruiser recording equipment.
When I asked you whether any of the requested audio/video in the first action even existed, or whether it was withheld, you stated that "it was not relevant" and that you would not "waste your time discussing it." When I asked whether you could check on whether the audio/video in the first action exists or ever existed you refused.
As stated, we deem the withholding of potentially exculpatory pertinent evidence a matter of grave concern.
Is it your continued position that you will not advise us whether the discovery which we requested exists, existed, or was destroyed? Or whether it was turned over to Cummings, McClorey, Davis, and Acho?
