RE: Wuterich writ appeal denied



So to fully preserve this issue, the next steps would be:
 
1)  Ask the CA to recall Vokey, using the same argument (JAG rules trump TX rules and TX rules acknowledge this).
 
2)  Request a site visit to Haditha and the opportunity to interview witnesses.
 
3)  At some point during trial, assert on the record that defense preparation has been negatively impacted by not having Vokey.   
 
Is that correct?
