RE: E-Vote Request on 2008-36: Criminal Jurisprudence & Practice Committee



My vote is:  A Oppose Amendments to 2008-36 (as stated by the position report)

 

            Having spent most of my career as a prosecutor I don’t think this is something that the criminal justice system needs.  Not only does it give the appearance of a large thumb on the scales of justice it, in my opinion, does just that.  It gives the prosecution a large right or advantage that the defense does not have.  It the defendant loses the motion his only option is to go through a trial, possibly at great expense to himself, to even get to the appellate court for review.
