Gentlemen and Lady,
I'm making very good progress on the Wuterich writ appeal tonight, though
there's no way I'll be able to finish it tonight. As I previously
indicated, there's no real practical difference between filing today, tomorrow
or Friday, since Code 46's reply deadline is the same regardless of which of
those days we choose to file.
In dealing with the Vokey conflict issue, it strikes me as a virtual
certainty that Colby would have represented clients while he was on active duty
even though they had conflicts with other clients represented by other counsel
in the same office. In fact, that might even be the case regarding this
case. For example, did anyone who worked in the same office as Colby
represent Chessani or any of Marine who was the subject of preferred charges
arising from Haditha?
