I am honored to have received such high praise.  We'll never give up the fight.
The Court of Appeals for the Armed Forces is, as you guessed, a five-member civilian court that is the highest military appellate court.  The next higher level is the highest, the Supreme Court of the United States, though no military case is automatically reviewed by that Court.  CAAF judges are appointed by the President and confirmed by the Senate for 15-yr terms.  That differs from other federal judiciary posts in that federal judges (both trial and appellate court judges) are appointed for life.  There is a prohibition against military retirees serving on CAAF, though most of its judges have had some military service.  There is no involvement by DoD in the nomination process.  For example, the service Judge Advocate Generals are not consulted.  It is a purely political process like the selection of other federal judges.  Folks deemed loyal to the President's party are the ones who get the nod, usually because they have friends in high places who ARE consulted.  The current Chief Judge, Andrew Effron, is due to retire this Fall.  President Obama has not yet named his replacement.  They can hear and decide cases with four members, but if there is ever a tie in voting, the appellate court decision being appealed is automatically affirmed.  A majority is needed to overturn a service Court of Criminal Appeals decision.
