 I was interested to see that Judge Maksym continued to attribute Vokey's desire to retire to Wuterich.  I think that's a pretty big mistake.  The invited error analytical framework doesn't really apply when the attorney and the client's desires no longer match.  It's not appropriate to say that "Vokey asked to retire and never asked to return," therefore it's Appellant's fault.  The point of our argument is that Wuterich wants Vokey--whoever severed the relationship.

This opinion is batshit crazy.  I'm developing a strong dislike for Judge Maksym.

We need to get this in front of CAAF ASAP while Chief Judge Effron is still there.  I'm supposed to leave for the USDB on Sunday afternoon.  Unless my power is knocked out by a hurricane, I'm optimistic that I can punch out a draft writ appeal on Saturday night/Sunday morning.  Hopefully one of you can then get it in shape to get over the finish line.  But it's much, much more important to file fast than to have it be perfect.
