Sounds like the complaint was taken and whether or not it mattered, she is going to a position at HQMC. I'd be interested to know if Col Baker ever filed a complaint with Navy JAG and/or any follow up was done with the Maryland State Bar. I am still trying to figure out my rights at this point and was given a couple of POCs to see if they can address my concerns. I will let you know what I find out. Haytham, do you have any scuttlebutt on how much longer MGen Ary will be SJA to CMC and who his successor may be? -dsw -----Original Message----- From: Haytham Faraj [mailto:haytham@puckettfaraj.com] Sent: Sunday, July 31, 2011 5:38 To: Wacker Capt Douglas S; Hur Capt Christian P Subject: FW: Complaint of Professional Miscoduct Gentlemen, Here's the Marine Corps' response. From: Haytham Faraj [mailto:Haytham@puckettfaraj.com] Sent: Monday, March 21, 2011 2:30 PM To: 'vaughn.ary@usmc.mil' Cc: 'Baker Col John'; 'john.harlow@usm.mil'; 'patricio.tafoya@usmc.mil'; 'Hur Capt Christian P'; 'Puckett Neal'; 'Bethany Trujillo'; 'kurt.brubaker@usmc.mil' Subject: Misconduct and interference with a judicial proceeding by Col Stephanie Smith Dear General Ary, I have attached for your attention correspondence regarding conduct that I believe constitutes ethical, criminal and professional misconduct by one of your senior judge advocates, Col Stephanie Smith. I withheld making these allegations until I could have the subject officer and other witnesses on the stand, under oath, to best evaluate the facts. I strongly recommend you review the transcripts from the 39a in the case of U.S. v. Wacker held on 22-24 February and 11 March 2011 and the judge's findings on the UCI issue as they provide a more complete record of the facts. I could not provide them to you as I do not have them yet but have asked that they be produced. I bring these charges with a heavy heart because it is never comfortable to accuse an officer of wrongdoing. My reservations regarding these allegations is but further proof of the seriousness with which I take these charges and the facts underlying them in this case and in others that you probably have some awareness of based on coverage by the Marine Corps Times. I look forward to your response Respectfully, Haytham Faraj, Esq.
