Mike,

 

You are asking to renegotiate a contract you and your wife agreed to and signed a year ago, I would prefer you abide by our current agreement and pay the rent that is due.  If you insist on continuing this charade I would want proof in writing that the money is with an attorney licensed in the state of New Jersey for the purpose of providing a security deposit for our current agreement at 12 Baxter Farm Road.    Of course I still need approval from my attorney before we do anything with the current contract.

 

As far as the water heater is concerned, you called me at 8:00am on Sunday June 5th and I had a plumber there by 12pm on the same day to fix the problem and have not heard a word about it since.  I will take this email as notification of an issue and will have someone look at it tomorrow June 20th.

                Our corporate counsel, Haytham Faraj and cc on this email, will hold corp funds in his client trust account for security deposit to cover one and one half months' rent. You can use already deposited funds today for the last one and one half months' rent.

 

                Also, on June 4th you had the plumber disconnect one of the hot water heaters, and do some maintenance on the other one. The water heater currently being used, as I have previously told you on June 5th, 7th & 11th shuts off every day and must be re-lit.

 

                Our movers are packing us out on the 29th and morning of the 30th so final walk thru will need to happen after 4pm on June 30th. I am also travelling that day so another company representative will attend the walk thru. His name is Ryan Shane. (I am trying to get us packed out on the 28th and morning of 29th, I will advise as soon as this is confirm this is possible with the moving company)

 

                If you correspond via email please ensure Haytham is cc'd on all.

Mike,

 

I will have people working on the house this coming week starting Monday June 20th 2011 it will take a couple of days to complete the repairs.  Please do not walk on or put anything on the deck until it is complete, the finish should be dry by Wednesday June 22nd but I will let you know when you can walk on it.  I would also ask you to cut the grass and maintain the property as agreed upon in the lease.  Regarding our latest conversation about the rent money due, I think you should review the lease agreement again, it clearly states that the security deposit cannot be used as payment of rent.  You are two months behind in rent payments, can you please pay the amount due so we can move on.  Your security deposit will be returned to you after our final walk through on Thursday June 30th at 9:00 am as agreed upon in the lease.
