Thanks for expedient reply.  I do have time to think about this since I have not received the docs stating that I have to make these choices.  I beleive I have strong case to retain and promote.  I have a statement from the young lady that supposedly was offended by what I said.  This statement specifically states that she was not offended by what I said and that I handled it appropriately.  
 
Aftert the NJP the CDRE recommended that I show cause and be removed from the promotion list.  I am currently on the 0-4 list. Anyway, I will call you this morning at 1115 my time.

I had hoped that this matter was over.  I am sorry to hear that they want to give you a BOI.  The issue of a General discharge is a Navy oddity.  I am familiar with it. They retired anther LT I know with an OTH. It makes no sense.  Someone needs to challenge the regulation in Federal court.  Until then, the Navy will continue to do it.  The Marine Corps agreed with a position paper I wrote that a retirement must by definition be honorable.  The problem is that the law is silent on the issue.  Defense lawyers and service members argue that it only makes sense that a retirement is honorable.  Government lawyers say that since the regulation is silent on the matter, they are free to characterize retirements as General or OTH. 

 

The decision to fight is of course yours.  You really have nothing to lose at the Board.  You can only be retired.  They cannot deny you your retirement.  What they will do is make a recommendation as to characterization at retirement and rank.  They can also, of course, recommend that you continue to serve.

Its been a while, and as you predicted I will be going to a BOI.  I have not see the letter from PERs but my options are retire or BOI.  A concern I have is that the LT at PERS that I talked to stated that I will retire with a General Discharge which makes no sense to me.  I would like to discuss possible services during the BOI.  I hope all is well and I look forward to hearing back from at soonest.
