I actually can't even get into the government spaces--I contact Mr. Keller the
same way you do. I just tried to call Maj Beth Harvey who can typically give
consent on routine enlargements but it appears she isn't in either.

Thanks, Maj Sip. I've left Brian Keller a message and e-mailed him but thus far
have received no response. Do you know if he's in today?

I'll file something by COB today with or without a response from Code 46, but I
believe that Mr. DeCicco can't grant it himself unless Code 46 consents.

Laughing. As a trial lawyer with very little appellate experience, normally the


only time I see the word, "enlargement," is in a spam ad targeting undersized

men.

Naturally I'd have no interest in anything like that.

As Neal pointed out before, our brief is due on Monday. I had hoped to have it


ready to file tomorrow, but that's not going to happen for two reasons: (1) I

had no power last night and my Comcast wi-fi was down for my laptop; and (2) it


sure would be nice to have access to the sealed docs before we file our brief,

so filing on Monday gives us a little more time for CAAF to let us see the

sealed exhibits. If we have to file before we see them, we'll drop a footnote

saying we may move to supplement our bried if CAAF grants our motion for access


to the sealed exhibits.



Unfortunately, I'm leaving early Monday morning to fly to MCAS Miramar for

Reserve duty. Maj Sip, will you be in on Monday? If so, can you take care of

the actual filing? If not, I'll go into the office Sunday evening and file.

(If Maj Sip can do that, I'll circulate a draft from home NLT Sunday evening.)

How long do we wait for CAAF to grant the motion to unseal the record. Aren't

they cutting into the time allotted to submit our brief? Given that there has

been no opposition from Code 46, isn't it time to unwrap the presents?
