David, thanks for your e-mail. I have cc'd my co-counsel in the case. Neal is the lead counsel and Haytham is his partner. They are both former Marine JAGs. Alas, I'm just the guy who causes trouble for the govt but with no military experience.

I'm sure we would all enjoy meeting with you when you are in DC. Neal would be the best to talk to about coming to see the trial in California, if it ever happens.

Dear Mr Zaid

 

I am writing to you in relation to the matter of Sergeant Wuterich, for whom I understand you act.

 

I am a barrister practising in Sydney, Australia.  I am also a part-time officer in the Australian Army.  Through the latter connection, I have been appointed to act as counsel to defend an Australian special forces soldier charged with manslaughter arising from an incident in Afghanistan in February 2009.  There has been an enormous amount of political and media debate about the issue in this country.  A reasonably accurate summary of the incident is set out in the attached article.  This is the first time in Australian history that a soldier has been charged with an offence arising from decisions made by him in combat.

 

I have been following the media’s reporting of the Wuterich matter for some time.  Although factually different to my matter, it would seem that the legal issues are very similar (ie. combatant immunity and whether a soldier owes a duty of care to non-combatants on the battlefield).  I understand that Sgt Wuterich will stand trial in January or February 2011.  I have some tentative plans to be in the United States around that time and would be interested in meeting you and perhaps even observing some of the trial.  Even if neither are possible, I would appreciate the opportunity to discuss with you over the telephone some of the legal issues you are dealing with in your matter.
