Re: Agency EEO Case

The of counsel relationship is what needs to be defined and both of our firm fee agreements should allow for the exchange of clients.

I gave Debra DC language for fee sharing but that's different from k work because debra will be atty of record
If we are part of each others firm then "k" work doesn't seem to be the way ahead coupled with who will be counsel of record.

Please standby while I do the grunt staff work to get you the Bar requirements and our draft consulting contract, since Mark may not have a template in his firm.  I'll try and get to it this am.  M

Per email below, Mark would like to have me as a contractor, which is easiest, but he also wants me to enter an appearance as co-counsel, which Iâm not sure works â because that would mean we really were splitting fees.

I donât have the pre-existing relationship with Mark that you all have, and I obviously donât want to get into fisticuffs over fees with him, so if we want to set up something wherein we split fees, Iâd like to make sure we are all on the same page with this.

Iâd also like to get this squared away so that we establish a practice for similar future situations.  He has a handful of EEO cases that I can jump in on, and Iâll likely have a handful of clients with messy clearance matters that he can jump in on.

The easiest thing is probably to bill you out as a contractor. We can avoid sharing fees. I can just bill you at $300/hr and make a whopping $25. Iâm always more interested in the working relationship with colleagues and helping the client than making money. One of my faults.
