Re: Wuterich trial



Meridith,
Not sure about Crossan.  He was the severely injured WIA at the IED.  
Just back from Okinawa.  Judge Jones is way behind on all of his work.  Our motion is still in the queue.  Said he'd work it over the long weekend.  Would not be surprised if we got a ruling early next week, but no guarantee from him.
Can you interview Crossan and get his recollections?  Perhaps he can be a defense witness by having heard something from someone else, like an admission.  But I'm not sure he ever returned to the unit.

Also, I had a phone call few minutes ago from a gentleman named James Crossen who said I was his POC and he was being subpoenaed as a witness in the Wuterich case.  And, he is unhappy about it and says he was unconscious during the whole event.  

Is he a defense witness?  I assume so otherwise the government wouldn't be giving out my name and number as POC.

You are correct, Sir.  I am tardy in getting notice to you, but we had filed a motion that could result in the case being set back again.  We've been anticipating a ruling "any day now" for about 3 weeks.  I apologize for the delay.  But in reviewing our case strategy it appears that we will not be needing your expertise in the Wuterich defense.
