Re: Wuterich
Actually, I think that your observation is helpful in trying to bridge
the gap between when Colby left active duty and when he sought to leave
the case. Unlike in Hutchins, the time bomb didn't immediately explode
precisely BECAUSE you and he sought to do the right thing in a manner
that the counsel's didn't in either Hutchins or Hohman. But now the
time bomb's clock has reached zero for Colby and the bomb whose timer
HQMC started when it refused to extend Colby on active duty is now
exploding.

I have never filed a notice of appearance as civiliancounsel in
Wuterich!ÂWe have the same case as Hohman, except that while
otherdetailed counsel chose not to show up in court after release from
active duty, whichis probably a violation of their professional
responsibility rules, we âColbyand I- continued to appear. The
question that keeps nagging at me is doesthe government then get to
argue that there is no violation of RCM 505, 506 andHutchins because we
showed up lest we receive the wrath of our State Bar
disciplinarycommittees and the live in infamy in appellate court
decisions that cast doubton our conduct?ÂHaytham Faraj, Esq.PUCKETT &
