Counsel-

Rule 7.14 of the EJC Circuit Rules states that proposed trial dates for special courts-martial should be within 30 - 45 days of the date of the docketing request or arraignment, and within 60 - 75 days of the date of the docketing request or arraignment for general courts-martial.  Exceptions to this Rule require the prior approval of the Docketing Judge. 

The charges in this case were preferred on 23 SEP 09, referred on 22 DEC 09, and served on the accused on 7 Jan 10.  I realize Mr. Faraj was not retained until February and a 706 board was requested and ordered by the Court, but the report of the board was submitted on 7 APR 10.  Now, we're into mid-May and the parties request trial dates in late August-early September, almost a year after preferral, and the requested dates fall well outside Rule 7.14's dictates.

Before granting the requested dates, we will have a 39(a) session at which the parties will articulate good cause for docketing the case so far outside the established time lines per the Circuit Rules.
