Sir, For the unwritten part of our suppression motion, failure to properly warn for false official statement & assault, the Defense will rely primarily on U.S. v. Erie, 29 MJ 1008. Due to issues with my NMCI access, I was not able to get further case law last night or this morning, but Erie should be sufficient. I will have hard copies for all parties this morning as well.
