Haytham, Sorry for the delay--yesterday was pretty crazy here. As I told Alex, I think you guys have a 50/50 shot at an NJP deal IF one or both of you present it to the CG. If we just push the paper offer up to him, I think the SJA will recommend disapproving it, and I think the CG will concur. On the other hand, if you and/or Alex pitch the deal in person, I think there's a good chance that he will agree to it. Obviously, it's up to you whether you think you should come down, but the CG may take it more seriously if you are there. [Alex-don't take that personally.] I can't make any guarantees, but I think you have a good shot if both of you present it in person. Let me know if/when you want to make it happen, and I'll get you on the CG's schedule. In the meantime, we'll set milestones to keep the ankle biters at bay. I think there must have been a misunderstanding. I had no desire to delay setting milestones. I am going to give Capt Wilschke my open dates for the purpose of trial and have him set trial milestones. I am in trial next week and the week after that. I wanted to come down to meet with the command to see if I can persuade them on the NJP. Do you think there's any benefit to the trip? I am doing this case pro bono so I would rather not spend funds unless you feel there may be some benefit from a trip. Have a good weekend Haytham -----Original Message----- From: Stewart Maj Matthew J [mailto:matthew.stewart@usmc.mil] Sent: Thursday, April 22, 2010 5:48 PM To: haytham@puckettfaraj.com Cc: Wilschke Capt Alexander R Subject: SIDDIQI Haytham, I'm getting a lot of heat to docket this case, and I can't delay any longer. Let's just set trial dates and milestones to keep everyone happy while we try to negotiate this PTA. I'm free whenever; just give me a proposed schedule, and we can submit that to the judge. Thanks.
