Re: Wuterich detailed counsel

Patricio,
Give us a bit of time to consider this.  We'll get back to you.

Gentlemen,
Capt Ellis is not available to be detailed.  Here is where we are at this point:

We are basically out of available, conflict-free counsel.  The only two remaining are Maj Meredith Marshall and "your's truly."  I would rather not wait until July/Aug for Maj Marshall to become a DC down at Miramar to put someone on this per the MJ's wishes.

Also, it is very probably I will be around in September since I am currently eyeing an end-of-year date to transfer to the reserves, so, you all might be stuck with me being the guy on the ground to do what is needed from this end.

Finally, inasmuch as I look at the file room and the daunting task of coming into this case 5 years after inception, I cannot in good conscience put that on one of "my" other DCs.  I have the time and will have to balance being an RDC and a DC.

So, unless you all have objections (and trust me, I don't think any of this is personal and would completely expect that for SSgt Wuterich all decisions made/opinions voiced are purely professional) I would submit that I am in the best position to take this.

You all know me by now; I don't have a history of taking complex cases like this; you know I don't want my name in lights (and Neal looks way better on Fox than I ever would); but I hope my reputation of being a hard working guy in the background (or as Vince Vaughn in Swingers would say, "The guy behind the guy") is also well-known.

Let me know your thoughts or any other counsel you know of that you would rather request.  I have the detailing authority in this case, so just let me know.

(The movie quote is included for Col Favors' amusement.)

V/R,
Patricio

Patricio:

Would you please detail Capt Yancy Ellis to the Wuterich case. As you know we have a trial date of September 13.  Yancy agreed to extend so long it doesnât take him beyond that.  We donât believe we will have any trial delays.
