I searched 6th Circuit Cases. Sorry to say that the inter-corporate conspiracy defense does not exist in criminal cases the 6th Circuit. I attach two cases in which the US Sixth Circuit Court of Appeals says so in no uncertain terms. The judges in each case says that in some Sherman Anti-Trust cases there may be such a defense, and that it may also exist in civil cases. However, the Court refused to extend this defense in criminal cases. I shepardized these two cases and they are still good law. Please let me know if you need anything more on this.
