Lisa,

·         Anticipated contract is FFP-LOE, but nothing in the description enables sizing the team to the workload other than the statement that the Govt anticipates 12-15 FTEs—there are no case loads or litigation projections that enable sizing.

·         Task:  Hire FLSA specialists (critical), review FLSA exemption status for all affected bargaining unit employees; collect documents—receive and inventory; process and code documents; key and scan data; create, design, and maintain litigation support databases; establish a secure website for staff use; consult and support all pre-trial and trial activities to include reviewing and responding to pleadings, pre-hearing/trial orders, discovery requests, reviewing responses to USAF discovery requests; assisting during depositions and deposition transcript processing; and support at hearing/trial)

o   Requires  para-legals (FLSA specialist to process and code documents), data transcription (deposition transcript processing), administration (collect, key and scan documents), and IT technical expertise (create, design, and maintain databases and create a secure website).  Seems to indicate that lawyers/attorneys are Government, not contractors.

o   Also provide experts in cross-examining opposing experts and experts to present hearing testimony on work performed IAW requirements.

·         Locations:  Vandenberg AFB, CA; Pope AFB, NC; San Antonio, TX; Denver, CO; Arlington, VA; and Joint Base Andrews, MD.  The RFP mixes language about contractor facilities and government facilities, and there is some indication of other locations than the six listed.  Did not say two people per location or any other number.

·         Meetings with trial team shall be conducted predominantly via Video Teleconference, at the contractor’s facility or  at government facility in the National Capital Region.

·         Requires 12-15 FTEs for 2.5 years—25 May 11-24 May 12; 25 May 12-24 May 13; and 25 May 13-24 Nov 13.

Personnel Qualifications:  The contractor shall provide a team of personnel with the necessary training, skills, qualifications, and security clearances to accomplish all requirements identified in this PWS.  Qualification summaries shall be submitted for validations of personnel’s skill sets.  In the event of contractor turnover of employees, qualification summaries shall be submitted through the Contracting Officer for verification of planner skill sets.

Personnel Litigation and Collective Bargaining Experience: At least two of the contractor team personnel, other than those hired to perform FLSA exemption status reviews, must have at least one year of work experience providing litigation support for personnel and/or collective bargaining matters.

Expert Selection and Support:  At least one of the team personnel shall have experience with the selection and support of appropriate experts to assist with the contemplated litigation.

DCPDS and DFAS Data Collection and Analysis:  At least one of the team personnel shall possess demonstrated ability to collect and analyze data regarding the Defense Civilian Personnel Data System (DCPDS) and Defense Finance and Accounting Service (DFAS).   

Litigation Management Experience: At least one of the team personnel shall have a minimum of ten (10) years of experience in managing complex class action litigation of personnel issues in a federal government and/or court environment, and have significant experience in the area of collective bargaining and the Air Force civilian personnel system.  Given the differences in the operation of personnel systems in the military departments, experience in the Air Force civilian personnel system is preferred.
