Laura, Mr. Faraj

there are two issues that have to be addressed. 

1. The value of the vehicle was submitted as $9800 because the appropriate documentation, such as a bill of sale and full packing list, was not provided in timely manner. In order to avoid demurrage and rollover charges, we entered the average value of the cars that are shipped through our company with the intention of amending it once the proof of purchase was provided.  However, even though requested over the phone, no complete packing list and/or the bill of sale was faxed, sent, emailed or handed to us.

2. There is still some items left in the container. If you want to proceed with the shipment of the items left, we need an updated packing list including description, quantity and value of the items left to send overseas. Please provide that ASAP so no extra demurrages would be acquired.

We're talking about the vehicle, not the remaining items in the container. Please CC me on the letter you are sending to Mr. Faraj by 2:00pm CST today.  



Regarding the list, Mr. Wahid already provided that to your company and that should be in your files. Please send me a copy of the file. If you do not have the material list in your file, let me know so we can start putting a new list together.

Dear Ms. Alijosius,

 

We have retained Mr. Faraj of the Law Firm of Puckett & Faraj, PC to assist us in this matter. He sent you an email yesterday, April 18th, 2011. His email is intented to assist us in releasing the vehicle from U.S. Customs & Border Protection. Your assistance would be very helpful in avoiding further delays and expenses. It is our position that as a result of your company's failure to provide U.S. Customs & Border Protection with the right documents is the reason why they seized the vehicle. Our position is that the vehicle was seized because of your company's negligence is further corroborated by your admission that you lost Mr. Marwan Wahid's file. 

 

You can assist us in recovering our property by drafting a letter stating that you, Nikki Alijosius, wrote the amount of $9,800 as the value of the vehicle without having any basis for using that amount or any direction or communication from Mr. Marwan Wahid, nor any of his agents. By doing so, you will assist us in getting the vehicle released and avoiding further administrative charges. This letter must be received by Mr. Faraj no later than 2:00pm Central Standard Time today or we will be forced to take legal action to compel your company to provide that information. Moreover, we will notify the State of Illinois of your failure to abide by the State's licensing requirements imposed on you by the State of Illinois.

 

Finally, any legal fees that we incur as a result of this matter will be your responsibility. I, therefore, hope that you will cooperate with us to avoid further delays and expenses.
