Mr. Faraj,
I am the lead trial counsel on the case against your client, S/SMITH.
Please correspond with me concerning scheduling or other matters in
preparation for Article 32 or trial. My assistant counsel is copied, LTJG
Lisa Redmond, as is military counsel for the accused, LT Charles Gough.
If you wish to submit a formal request for a change in Article 32 date to
the Convening Authority, please feel free to do so. I do not have the
authority to grant or deny your request.
Because of unusual circumstances, my advice in this case will be that the
continuance request not be granted. Unfortunately, due to Victim, Witness,
and Investigating Officer availability, it is not possible to reschedule the
Article 32 in this case to April 27th. The IO is not available on April
27th. The courtroom is being used the following week for a contested GCM.
FN Dull's ship will be deploying the following week.
Please give me a call if you have any further questions concerning
scheduling; otherwise, I will wait for your request.
