Possible story of interest for you



Hi Gidget,

I came across some very questionable, and arguably, illegal acts by a senior officer at MCRD –Col Stephanie Smith.  In the interest of full disclosure, she’s also named in a UCI motion in the Wacker case. 

 

I am considering filing an IG complaint or perhaps something more serious but I thought you might be interested in the story as well.  The facts are not related to cases I am working on.  An officer at MCRD who asked to remain anonymous came to me with the several incidents of misconduct because he knew I am going after her in my UCI motion.  He asked if I could help because he is afraid his career would be affected if he did something.  I think that fact alone speaks for itself.  Here are a couple sample incidents:

 

Violation of the law:  Article 93 (cruelty and maltreatment), LEGALADMINMAN Chapter 15

Incident Summary: 

1)    Despite meeting Sgt King’s wife, Col Smith begin to suspect that Sgt Sidney King was in a contract marriage with a civilian woman in New York.  A geographical bachelor, Sgt King was ordered to move out of his home in Temecula, CA so that Sgt King lost his contract to purchase his home.  Sgt King ended up living in his car for a week in the barrack’s parking lot as a result of this order. 

2)    Even though there was no complaint of nonsupport, Col Smith ordered Sgt King to pay $850 per month to the mother of Sgt King’s biological daughter with another Marine in North Carolina.  When legal assistance attorney Capt Clinger pointed out to Col Smith that this order was illegal and excessive, Col Smith intimidated Capt Clinger for doing his job.  Later, Sgt King initiated an IG Complaint against Col Smith, but Col Smith received that IG Complaint.

Witnesses:  Sgt Sidney King, Capt Aaron Clinger.

 

Violation of the law:  Article 93 (cruelty and maltreatment)

Incident Summary:  PFC Sutton was a Marine on restriction.  He missed his evening chow.  The barracks duty at the time, a Cpl Medina, gave Sutton some pizza because he was hungry.  Sutton and Medina were NJP’d for this offense by Col Smith.  Reportedly, Cpl Medina was reduced to LCpl and given restriction.  Medina is a single mother.  Her NJP and restriction for feeding a hungry Marine who missed chow separated her from her child from the period of the restriction.

Witnesses:  PFC Sutton, Cpl Diana Medina

 

These are two examples of about seven different incidents.  I have a meeting with MGen Bailey this week to bring up these issues.  He’s a good man and I believe he will care but I don’t trust the investigative system because Smith has substantial influence at the Depot.
