Guven, As I predicted, the Navy and Marine Corps Court of Criminal Appeals has set aside San's conviction and sentence and dismissed his case. We won! That means as of today, is no longer convicted and does not have a bad conduct discharge. The court did, however, as it usually does, authorize a rehearing. That means that, as we discussed on the phone, the command in Okinawa can choose to order him back to Okinawa, charge him again and take him back to a court-martial in Okinawa. We don't know what they'll do, and it could take days or weeks for them to decide. In the meantime, though, San rates full back pay and get his rank back. He is now a LCpl on active duty, but still on authorized appellate leave. We can discuss this tomorrow if you'd like. I'll let you know as soon as I hear something from Okinawa.
