Mr. Fournier, I apologize for our misunderstanding. We did not understand from your initial contact with us that you expected to get a face to face consultation with Mr. Faraj. That is our fault, not yours. But the fact remains that unfortunately, Mr. Faraj is still unable to accept your case due to his current case load. Because we misunderstood your expectation, we are immediately and fully refunding your $150 consultation fee. Marcy will put a check in the mail today. Again, I offer our sincere apologies. Respectfully,
Neal A. Puckett, Esq LtCol, USMC (Ret) Puckett & Faraj, PC Washington DC Metro Area 888.970.0005

Subject: Re: Declination of pro bono representation
I was under the impression when I received the referral to
your Law Offices from the Michigan Based Feiger Law Firm I would have
had the opportunity to actual meet with attorney Faraj in Dearborn Heights (5
minutes from my residence). When I submitted the $150.00 that is precisely
what I expected to transpire...believing the information submitted to
"Marci" was to bring you up to speed of my complex situation...I believe I
deserve an actual one on one meeting with someone here in Michigan...common
guys; I've been wronged by government...I'm sure my rights under the UCMJ were
somehow violated during the court martial proceedings against those three
Marines who were acquitted in the assault and robbery they perpetrated
against me on September 11th, 1961. I deserve justice and a full
administrative review of at least the first application before the BCNR filed in
1988. All I need to know at this point is what federal agency
holds jurisdiction over the BCNR? Who do I file my concerns with in
regard to due process violations I believe to exist in that first
filing?
As far as your office representing me...if I had $5000.00 I
would gladly forward it immediately. I need proper representation in this
matter and I believe you folks have the legal knowledge to "set the
record straight"...I need time to raise the monies and just maybe the
Judges deciding on the COVA oral arguments over the effective date of my
VA claim will rule in my favor? (Arguments given January 14, 2010
before Judge Green, Davis, and Heigle.

Mr.
Fournier,
Good morning, Sir. I am the Senior Partner at Puckett and Faraj.
Due to Mr. Faraj's current caseload, he is not accepting new BCNR
clients for the foreseeable future. I have reviewed the results of your
initial consultation with Mr. Montalvo, including his evaluation of your case.
Beyond that initial consultation, we cannot give legal opinions or
recommendations for further courses of action without being retained to
represent you. We have considered your description of what efforts you
have made already, the quantity of documents to be reviewed and Mr. Montalvo's
prognosis of the amount of time involved to review the file, devise a strategy
and execute that strategy. The proposal you received from our business
manager yesterday is our best offer on the costs involved to assist you with
your case. We regret that we must decline your request for pro bono
assistance.
Please let us know if you would like to retain us on the terms provided
in Ms. Atwood's email message below. If you choose to represent yourself
or look elsewhere for assistance, we wish you the very best of luck with your
case and thank you for your years of service to our nation.
Very respectfully,
Neal A. Puckett,

The evidence is in my favor (but of course I have a biased
opinion)...its been to many years and too many tears (three failed
marriages, hundreds of jobs, and fighting the bureaucracy not to mention
alienation from family members because of my psychological impairments through
the troubled years of acting out inappropriately)...what does it take to file
a De Novo review before the BCNR? I really need a compassionate hearted
Law Firm to first look at my evidence (pro bono to start), and then map out
the costs...what can I do on my own? I can represent
myself...I just need some guidance as to the procedure to file and the Agency
that would do the De Novo review. I was wronged by the Navy by
their failure to properly offer a proper through medical review BEFORE
issuing the 2nd Honorable Discharge...I have a Ton of Evidence pointing to the
True Facts of the Record. Attorney Faraj has the Caliber of Excellence
needed in my Case Scenario (PTSD & three (3) documented head injuries that
DID NOT receive competent treatment. What do you suggest? I
can try to raise the initial $5000.00. I do not believe I have to
worry about a Statute of Limitations before the BCNR because they are the
guilty party in inflicting the Due Process Violation of the first claim filed
and in the subsequent filings since 1988. How does an Honorable person
attain justice in America in light of the guarantees provided in the 1st
Amendment to the Constitution?
Good
Day Mr. Fournier, I spoke with Mr. Montalvo just prior to his departure
OCONUS and he reviewed your EMails. Your indication of the amount of
paperwork and research you have already accumulated plus the description of
your case and your goals for the two Due Diligence issues (One for the BCNR
and one for the VA) has helped Mr. Montalvo identify the associated fee
requirements. Even with your most recent direction of just approaching
the Due Diligence issues for the BCNR it will require significant legal
work. For the Law Firm of Puckett & Faraj PC to provide you
the services you are seeking, we would require an hourly contract with you
with an initial Fee Advance of $5000.00. It could be that the final
billing would be well over $10,000.00 based on your description of the
issues.
If you wish to proceed, please let me know, and I will send you a fee
agreement and tell you the options for paying the initial fee advance of
$5000.00. You can contact me, Monday through Friday from 9 AM to 5 PM
Eastern time at 888-970-0005, Ext 3.
Thank You and have a great week!
Sincerely,
Marcy
