Thanks for getting back w/me. Capt Porter was able to find an email
from you in which you indicated you wanted to try the case on 22 - 24
Oct. Capt Harris earlier indicated the defense was amenable to the
email exchange serving as a substitute for the required docketing
conference. As a result, I went ahead and docketed the trial for the
agreed upon date. I've attached a copy of the confirmation letter which
will go out tomorrow.

Good day, Mr. Plude. I do indeed agree to email exchange. I write
from Okinawa Japan where I just read the traffic between the parties
at 0545 on Wed 24 Sep. I would affirmatively request the propsed
trial dates of 22-24 Oct 2008. Thank you for your assistance.

Mr. Puckett,
Do you concur w/trial date proposed by the government (i.e., 22 -
24
Oct) and do you consent to my considering the email exchange w/parties
as a substitute for the docketing conference required by the Uniform
Rules of Practice before Air Force Courts-Martial?

Gentlemen,

While Mr. Puckett has the final say, I am available on the proposed
dates. I have no objection to this email serving as the docketing
conference,

Best Regards,

Capt Harris

Does the defense agree w/proposed trial date of 22 - 24 Oct? If so,
I'll need to see if I can find a judge as there are no Western Region
judges currently available that week. The Uniform Rules of Practice
before Air Force Courts-Martial require that I conduct a docketing
conference if an agreed trial date is more than 30 days after the
service date (as is the case here). However, if the parties are
amenable to this email exchange serving as a substitute for the
required
docketing conference, I'll docket the trial w/o further ado, provided
I
can find a judge. Let me know if both sides agree. Otherwise, I want
to do a docketing conference either this afternoon or tomorrow to set
a
trial date.
