There is a military case on the matter, and this one was government email not personal email.

United States v. Long, 64 M.J. 57, 63 (C.A.A.F. 2006).

Here was the paper I wrote on 18 USC 2701 et seq. and Warshak v. US. The case was later overturned by the 6th Cir. en banc, and I'm not sure if it went to the Supreme Court or not. A quick Westlaw search would probably turn it up.

I know the case law isn't in my favor, but the arguments are still there.
