(See attached file: Criminal Jury Instructions--Master (revised July 2009).pdf)(See attached file: Instructions for Completing Jury Instructions.pdf) Dear U.S. v. Hamama Attorneys, I have attached copies of Judge Edmunds' standard jury instructions for criminal cases, as well as a separate file with her instructions to counsel on how to prepare joint jury instructions. The master jury instruction file contains spaces for the insertion of instructions specific to this matter. In addition, feel free to delete any instructions that you know will not apply in this case - we recognize that some may need to wait until all the proofs are in before a determination is made. The main point from the Judge's instruction file is that she expects you to confer before trial and to produce a joint set of instructions that you both can agree on. You are to submit these instructions to the Court. If there are two or three instructions that you cannot agree on, then each side should submit a separate file listing their proposed language for the disputed instruction, a brief statement in support of the proposed instruction (with relevant authority), and a brief statement in opposition of the other side's version. Again, these two files should be submitted both electronically and on paper. Judge Edmunds will then rule on the disputed instructions prior to the end of trial. Should you have any questions on these procedures, please do not hesitate to contact me. Jordan Paterra Law Clerk to the Honorable Nancy G. Edmunds U.S. District Court for the Eastern District of Michigan (313) 234-5155
